Terms and Conditions of the UGC Contest of HKM Heilbäder und Kurorte Marketing GmbH Baden-Württemberg

The following terms and conditions apply to participation in the UGC sweepstakes:

I. Organizer, eligibility

1. HKM Heilbäder und Kurorte Marketing GmbH Baden-Württemberg, Esslinger Straße 8, D-70182 Stuttgart (hereinafter referred to as the „Organizer“) is the organizer of the promotion and is therefore solely responsible for its implementation.
   
2. All users who are at least 18 years old at the start of the competition and have a valid postal address and permanent residence in Germany are eligible to participate. The prize will not be awarded to persons under 18 years of age.
   
3. A person gets a chance to win a small wellness package by taking a photo of a relaxing moment in one of the 55 health resorts and spas in Baden-Württemberg. The photo must be shared on Facebook or Instagram, the natur.erholt. account must be linked, and the spa town must be mentioned. Additionally, you must be a follower of the natur.erholt. Instagram account. The participant is responsible for the accuracy of their information, especially their email and/or postal address. Entries for the competition must be received within the specified timeframe.
   
4. Employees of the organizer and affiliated companies, as well as their relatives, are excluded from participation. Employees and relatives of companies involved in the execution of the prize draw are also excluded from the prize draw.
   
5. In case of a violation of the terms and conditions, HKM Heilbäder und Kurorte Marketing GmbH Baden-Württemberg reserves the right to exclude individuals from the competition.
   
6. Individuals who use unauthorized aids or otherwise gain an advantage through manipulation will also be excluded. If necessary, in these cases, winnings can also be retroactively revoked and reclaimed.

II. Conducting the Sweepstakes

4. By submitting or linking, the applicant confirms that they have the right to grant usage rights, either because they are the author themselves or because they are otherwise authorized to grant usage rights.
   
5. If a winner cannot be reached via their Facebook or Instagram account, or if the prize cannot be delivered to the subsequently provided postal address, the original winner's prize will be forfeited. The prize will be awarded to the next determined participant who has not yet won.
   
6. If the winner does not respond within 10 days of notification, the claim to the prize will be forfeited.
   
7. The claim to profit or profit share cannot be assigned.
   
8. The names of the winners may be published on the organizer's website and social media channels. Participants expressly agree to this form of publication.

III. Liability

1. The liability of the organizer, as well as its vicarious agents and persons employed in performing an obligation, for culpably caused damages, including consequential damages, is excluded, provided that the damage was not caused by intent or gross negligence. This does not apply to damages arising from injury to life, body, or health, or the culpable breach of essential contractual obligations.
2. In the event of a culpable breach of essential contractual obligations, based on circumstances other than intent or gross negligence, the organizer's liability is limited to the typically foreseeable damage.

IV. Data Protection

1. Participation in the „Prize Draw“ is voluntary. The entity responsible for the collection, processing, and use of personal data within the scope of the prize draw is HKM Heilbäder und Kurorte Marketing GmbH Baden-Württemberg, Esslinger Straße 8, D-70182 Stuttgart.
   
2. For participation in the „Prize Draw,“ personal data must be provided. The personal data will be stored electronically and used for the processing of the prize draw.

VI. Final Provisions

1. HKM Heilbäder und Kurorte Marketing GmbH Baden-Württemberg reserves the right to cancel the sweepstakes for good cause without prior notice, especially if its proper execution cannot be guaranteed for technical or legal reasons.
   
2. Legal recourse is excluded.
   
3. The execution of the promotion, the legal relationship between the organizer and the participant, as well as these participation rules, including their interpretation, shall be governed exclusively by German law, to the exclusion of any legal provisions referring to another legal system.
