Terms and Conditions for the HKM Heilb\u00e4der und Kurorte Marketing GmbH Baden-W\u00fcrttemberg Sweepstakes<\/strong><\/p>\n\n\n\n

The following terms and conditions apply to participation in the competition:<\/p>\n\n\n\n

I. Organizer, eligibility<\/strong><\/p>\n\n\n\n

  1. HKM Heilb\u00e4der und Kurorte Marketing GmbH Baden-W\u00fcrttemberg, Esslinger Stra\u00dfe 8, D-70182 Stuttgart (hereinafter referred to as the \u201eOrganizer\u201c) is the organizer of the promotion and is therefore solely responsible for its implementation.
    <\/li>\n\n\n\n
  2. All users who are at least 18 years old at the start of the competition and have a valid postal address and permanent residence in Germany are eligible to participate. The prize will not be awarded to persons under 18 years of age.
    <\/li>\n\n\n\n
  3. A person participates in the sweepstakes by answering the question in the comments section of the sweepstakes post on the natur.erholt Facebook or Instagram account. In addition, individuals participating via Instagram must be subscribers of the natur.erholt Instagram account. The participant is responsible for the accuracy, especially of their email and\/or postal address. Sweepstakes entries must be received within the time limit specified in the sweepstakes.

  4. Employees of the organizer and affiliated companies, as well as their relatives, are excluded from participation. Employees and relatives of companies involved in the execution of the competition are also excluded from the prize draw.

  5. In case of a violation of the terms and conditions, HKM Heilb\u00e4der und Kurorte Marketing GmbH Baden-W\u00fcrttemberg reserves the right to exclude individuals from the competition.

  6. Individuals who use unauthorized aids or otherwise gain an advantage through manipulation will also be excluded. If necessary, in these cases, winnings can also be retroactively revoked and reclaimed.<\/li>\n<\/ol>\n\n\n\n

    II. Conducting the Sweepstakes<\/strong><\/p>\n\n\n\n

    1. In total (Facebook and Instagram), there are 10x2 vouchers for the Albtherme Waldbronn to be won in the giveaway starting May 16, 2024. The giveaway runs from May 16, 2024, until May 20, 2024, 11:59 PM CET, inclusive. To participate in the giveaway, you must answer the question posed and follow the instructions in the giveaway post.

    2. The winners will be randomly drawn from all comments on the competition posts on Facebook and Instagram no earlier than the next business day, and will be contacted by HKM Heilb\u00e4der und Kurorte Marketing GmbH Baden-W\u00fcrttemberg.

    3. The participants are responsible for the accuracy of the contact details provided. HKM Heilb\u00e4der und Kurorte Marketing GmbH Baden-W\u00fcrttemberg assumes no liability for the timeliness, completeness, or accuracy of the transmission of participant data.
      <\/li>\n\n\n\n
    4. By using the comment function, the organizer is granted the unlimited right in time and space to publish and reproduce these works on their own website as well as on various social media channels, such as Facebook & Instagram.
      <\/li>\n\n\n\n
    5. With this comment, the applicant confirms that they are authorized to grant the usage rights, because they are either the author themselves or are otherwise authorized to grant the usage rights.
      <\/li>\n\n\n\n
    6. If a winner cannot be reached via their Instagram or Facebook account, or if the prize cannot be delivered to a postal address submitted at a later date, the original winner's prize will be forfeited. The prize will be awarded to the next determined participant who has not yet won.

    7. If the winner does not respond within 5 days of the notification being sent, the claim to the prize will be forfeited.
      <\/li>\n\n\n\n
    8. The claim to profit or profit share cannot be assigned.
      <\/li>\n\n\n\n
    9. The names of the winners may be published on the organizer's website and social media channels. Participants expressly agree to this form of publication.<\/li>\n<\/ol>\n\n\n\n

      III. Liability<\/strong><\/p>\n\n\n\n

      1. The liability of the organizer, as well as its vicarious agents and persons employed in performing an obligation, for culpably caused damages, including consequential damages, is excluded, provided that the damage was not caused by intent or gross negligence. This does not apply to damages arising from injury to life, body, or health, or the culpable breach of essential contractual obligations.<\/li>\n\n\n\n
      2. In the event of a culpable breach of essential contractual obligations, based on circumstances other than intent or gross negligence, the organizer's liability is limited to the typically foreseeable damage.<\/li>\n<\/ol>\n\n\n\n

        IV. Data Protection<\/strong><\/p>\n\n\n\n

        1. Participation in the \u201ePrize Draw\u201c is voluntary. The entity responsible for the collection, processing, and use of personal data within the scope of the prize draw is HKM Heilb\u00e4der und Kurorte Marketing GmbH Baden-W\u00fcrttemberg, Esslinger Stra\u00dfe 8, D-70182 Stuttgart.

        2. For participation in the \u201ePrize Draw,\u201c personal data must be provided. The personal data will be stored electronically and used for the processing of the prize draw.

        3. The organizer processes and uses this personal data exclusively for the execution of the prize draw. The data will be passed on as necessary to a service provider commissioned by the organizer to support the execution.         4. The data will be deleted after the statutory retention period has expired.

This applies to the collection and use of your personal data. We are also happy to assist you if you wish to correct, block, or delete your data, or in case of complaints, requests for information, or general questions about data protection.           VI. Final Provisions<\/strong><\/p>\n\n\n\n

          1. HKM Heilb\u00e4der und Kurorte Marketing GmbH Baden-W\u00fcrttemberg reserves the right to cancel the sweepstakes for good cause without prior notice, especially if its proper execution cannot be guaranteed for technical or legal reasons.

          2. Legal recourse is excluded.
            <\/li>\n\n\n\n
          3. The execution of the promotion, the legal relationship between the organizer and the participant, as well as these participation rules, including their interpretation, shall be governed exclusively by German law, to the exclusion of any legal provisions referring to another legal system.<\/li>\n<\/ol>\n\n\n\n
